SIGKILL changing UL/DL rates

Hi to all.
As I was discussing with STU REDMAN in another topic, I frequently have this problem using my aMule.
Today I had the idea to check constantly dmesg during the operation and after the SIGKILL I faound what is in the attachment.

I try to give more info:
System is based on AMD Athlon 64 X2 5200
1 GB of memory (2 x 512 MB on dual channel)
swap aerea 620 MB
Ubuntu Intrepid 8.10 AMD64
Amule SVN 9278

Initially I supposed that this problem was due to the fact that I had no swap area, after I restored the swap something has improved, but is still not perfect.

Now my answer is: The out of memory problem reported in dmesg can be an Hardware problem or a System problem or a Software problem?

I don't have the knowledge to understand that, but if someone can help me I will post in the right place to obtain a solution.

Ok I'm  waiting for an answer from the rt73 drivers developpers.
Meanwhile a question:
why when I change the UL rate for some rates automatically is setted a specified DL rate? ie if I set an UL rate of 8 the DL is setted to 32.
It is not possible to set the desired UL and DL rates independentely?
